THE MDI FRAMEWORK: WHY DISORDER DRIVES RISK

The Moral Disorder Index measures institutional and structural disorder across 195 countries and seven dimensions: Truth (press freedom, information integrity), Authority (rule of law, governance legitimacy), Body (violence, exploitation), Family (social cohesion), Sovereignty (territorial control, border integrity), Sacred (religious freedom), and Creation (property rights, environmental governance). Scores run from 0 to 100; higher scores indicate greater disorder. Countries are assigned to six bands: Low, Concerning, Elevated, High, Critical, and Severe (unseenfront.com/moral-disorder-index).

For maritime risk analysis, two MDI dimensions carry particular predictive weight. The Authority dimension tracks the breakdown of legitimate governance and rule of law - the structural condition that enables criminal networks to operate without accountability. The Sovereignty dimension tracks the state’s ability to control its territory and waters. When both are elevated simultaneously, as they are in Somalia (Authority 78.7, Sovereignty 24.5) and Yemen (Authority 81.4, Sovereignty 27.4), the result is a maritime environment where piracy and illicit activity face no credible deterrent. The Creation dimension, which covers property rights and rule of law over physical resources, also matters: Yemen scores 5.6 and Somalia 26.8 - among the lowest in the entire 195-country dataset.

MDI SCORES ACROSS ALL THREE CORRIDORS

CORRIDOR ANALYSIS

This corridor carries the most severe MDI profile of any major shipping zone worldwide. Six of seven corridor states score elevated or higher; five are Worsening. In July 2026, the Houthis declared a maritime embargo against Saudi Arabia, prompting war-risk premiums to rise from approximately 0.3% to 0.75% of hull value within 48 hours (Saul, Reuters, 20 July 2026). Fully closing the strait would reduce global oil supply by an estimated 7% (Reuters). Simultaneously, Somali piracy resurged: four vessels were seized in under two weeks in April-May 2026, including the Emirati-linked oil tanker Eureka, for which a $10 million ransom was demanded (Madey, The Hill, August 2026). A 2025 UN Panel of Experts report documented direct meetings between Yemen-based networks and Somali militant groups, resulting in weapons and GPS targeting equipment flowing across the Gulf of Aden (Madey 2026). The MDI correctly predicted this: Yemen’s Authority score of 81.4 and Somalia’s Severe-band ranking reflect exactly the conditions - legitimacy collapse and coercive governance - that make the corridor a production site for proxy warfare and criminal piracy simultaneously.

The Strait of Malacca and Singapore (SOMS) carries approximately 60% of global trade by volume (CNA, January 2026) and is the primary transit route for semiconductor inputs, electronics, and East Asian energy imports. In 2025, ReCAAP recorded 108 incidents in the SOMS - a 74% year-on-year increase and the highest figure since 2007 (ReCAAP Annual Report 2025). Bulk carriers accounted for 52% of targeted vessels; 87% of incidents occurred in the first seven months of 2025 before arrests by Indonesian authorities disrupted the networks in July-August. The MDI profile explains the character of this activity: corridor states average 34.9 - meaningfully lower than Bab el-Mandeb - and no state scores in the Critical or Severe band. The result is high-frequency, low-severity crime (engine spare theft, opportunistic boarding at night) rather than hostage-taking or weaponized embargo. Myanmar is the notable outlier at MDI 39.5 (High, Worsening, Authority 65.3, Coercion 77.6) and represents the primary corridor deterioration risk if junta control extends into Andaman Sea and Malacca approaches.

The Gulf of Guinea carries the most dangerous profile for crew. In 2025, 21 incidents were recorded - a seemingly modest figure - but they accounted for 92% of all crew kidnappings globally, with 23 seafarers abducted, up from 12 in 2024 (ITF / IMB Annual Report 2026). Average ransom demands exceed $500,000 per hostage (Turqoa 2026). Kidnap-for-ransom operations targeting senior Western crew members are well-organized and frequently executed by Nigerian Delta networks (USDOT Maritime Advisory 2026-009). The corridor MDI average of 37.2, with five of seven states in the High or above band, produces a specific threat profile: organized criminal networks with state indifference, operating in waters where coastal authority is nominal. Three states - Ivory Coast, Cameroon, and Togo - are worsening, meaning the MDI trajectory points toward increased disorder in the precise coastal zones where piracy operates. The relative improvement in headline incident counts is partly attributable to Nigeria’s Deep Blue program and increased naval patrols, but the IMB acknowledges significant underreporting, with actual incidents estimated at two to three times official figures (Turqoa 2026).

INSURANCE RISK: THE FINANCIAL ARCHITECTURE OF MARITIME DISORDER

The Lloyd’s Joint War Committee (JWC) - the body that sets listed areas triggering war-risk coverage clauses in hull insurance - is effectively a real-time institutional assessment of MDI-type conditions. When it listed the southern Red Sea and Bab el-Mandeb in December 2023, standard annual policies were suspended for those waters and premiums repriced on a voyage-specific basis (CIMSEC, June 2026). The mechanism creates direct corporate cost at the transaction level: a $100 million hull that previously paid ~$125,000 per annum in war-risk coverage now pays $500,000 to $1,000,000 per Red Sea transit (CIMSEC 2026). At peak Hormuz exposure in March 2026, some VLCCs paid $7.5 million per single voyage - equivalent to 15-20 years of pre-crisis coverage (Eastern Herald, July 2026). Energy and oil tankers bear the largest share: they commanded 42.5% of total war-risk gross written premiums in 2025, estimated at $3.6 billion (Research Intelo 2026).

INCIDENT TRENDS AND TRAJECTORY

The incident trend chart illustrates a structural divergence between corridors that MDI scores anticipated. The Malacca-Singapore surge in 2025 (108 incidents, up from 13 the prior year in the Singapore Strait alone) followed a multi-year period in which Indonesia’s MDI Worsening trend - particularly its Authority dimension rising from 55 to 60.7 - signaled weakening coastal enforcement capacity. The subsequent arrests in July-August 2025 produced a sharp second-half decline, consistent with the MDI hypothesis that enforcement capacity, not structural disorder, is the primary short-term determinant of incident rates in mid-disorder corridors. In the Horn of Africa, the 2025 resurgence follows a decade-long pattern in which international naval attention, rather than MDI improvement, suppressed piracy. When that attention was diverted to Houthi missile defense, the structural MDI conditions that had been present all along reasserted themselves immediately.

MDI AS A LEADING INDICATOR: WHAT THE DATA PREDICTS NEXT

Standard maritime risk assessments - the IMB annual report, ReCAAP weekly advisories, BIMCO’s MISTO, U.S. MARAD advisories - are incident-driven. They tell operators where attacks occurred last month. The MDI measures the structural conditions that produce attacks before they happen. Three signals in the current dataset carry forward-looking significance for companies operating in these corridors.

The crypto industry has put about $189 million into this year's midterm races while the Senate weighs a bill setting federal rules for digital assets. Senator Cynthia Lummis says she personally negotiated the bill's ethics provision with President Trump, giving him a choice between a blind trust or divesting his crypto holdings. His own financial disclosure showed his 2025 income reached about $2.2 billion, and $1.4 billion of that came from crypto ventures he holds.

Latin America is widely marketed to investors, insurers, and lenders as one of the last large underpenetrated growth markets for life insurance, health insurance, consumer credit, and microfinance — a story built on urbanization, a rising middle class, and financial inclusion.¹ This report tests that narrative against the Moral Disorder Index (MDI) for three of the region’s largest such markets: Mexico, Colombia, and Ecuador.

The evidence rejects the null hypothesis. All three countries sit in the MDI’s Critical band (44–49 of 100), each scoring above the global average of 34.8 across every disorder category examined except Sovereignty.² Body and Family — the two loss channels most directly tied to mortality, morbidity, and repayment culture — are elevated 15–25 points above the 195-country global average in all three markets.² Coercion scores are Moderate-to-Low, meaning the disorder is not primarily a product of state repression suppressing dissent; it is socially and structurally embedded, which makes it a durable underwriting and credit-risk variable rather than a transient political shock.³

Crucially, conventional metrics can actively mislead here. Mexico’s homicide rate fell to a seven-year low of 15.4 per 100,000 in 2025 — a headline that a standard country-risk model would read as “improving.”⁴ Yet Mexico’s MDI Total score (48.3) and Authority score (53.8, the highest of the three) show no corresponding improvement in institutional integrity, because the disorder driving the score is corruption, impunity, and cartel-linked financial crime rather than raw violence alone.² Ecuador shows the opposite divergence: its homicide rate hit a regional record of 50.9 per 100,000 in 2025, a 30% year-over-year surge, which the MDI Total score (45.6) already anticipated by ranking Ecuador’s Body sub-score among the highest of the three well before the headline crisis fully materialized.^5,6,2

None of the three countries appears on the FATF grey or black list as of the June 2026 plenary.⁷ But a June 30, 2026 FinCEN supplemental alert and coordinated OFAC sanctions action targeting Mexico-based cartel fuel-smuggling and tax-evasion networks confirm that formal compliance clearance understates ground-level financial-crime exposure.^8,9 For institutional users, the conclusion is not “avoid Latin America” — it is that headline macro and even declining-crime narratives should not be used as a substitute for structural, category-level risk pricing.

Market Narrative

The conventional pitch for Latin American life, health, and credit markets rests on three pillars: rapid urbanization concentrating consumers in formal financial and insurance systems; a rising middle class with growing insurable and creditworthy populations; and chronic under penetration — insurance and formal credit penetration in Mexico, Colombia, and Ecuador remain well below OECD averages, implying substantial runway for premium growth, loan book expansion, and microfinance outreach.¹ Multinational insurers, reinsurers, and consumer-lending platforms have used this framing to justify aggressive regional expansion, treating country risk primarily through the lens of GDP growth, currency stability, and headline crime trends — with Mexico’s declining 2025 homicide rate frequently cited as evidence the region is de-risking.⁴

Hypothesis Test

Null Hypothesis

Latin America’s growth markets for life insurance, health insurance, consumer credit, and microfinance are not associated with elevated moral-disorder risk; conventional macro and declining-crime indicators are sufficient for country-level underwriting, credit, and capital-allocation decisions.

Alternative Hypothesis

Latin America’s growth story masks structurally elevated moral-disorder risk — concentrated in Body, Family, and Authority — that is material to claims experience, default rates, and reputational and compliance exposure, and that conventional or declining headline crime metrics do not adequately capture.

Sector Selection

Sectors analyzed: life insurance, health insurance, consumer credit, and microfinance.

Exposure mechanism: These four sectors share direct, quantifiable exposure to the same underlying disorder channels:

• Life insurance — mortality risk is a direct function of violence, homicide, and health-system fragility (Body).

• Health insurance — morbidity, fraud, and claims volatility track institutional weakness and health-system corruption (Body, Authority).

• Consumer credit — default and repayment behavior are shaped by household stability, informal-economy dependence, and trust in formal institutions (Family, Authority).

• Microfinance — branch-level security, cash-handling risk, and borrower repayment culture are exposed to both violent crime and family/household disorder (Body, Family).

Per the MDI category weighting, Body (27%) and Family (20%) together account for 47% of the Total Score — the two largest single components — making these sectors an unusually direct test of whether MDI structural risk and conventional financial-sector risk assessment produce the same answer.³

MDI Category Selection

This analysis uses four categories, consistent with the standard sector-mapping logic for life, health, disability, consumer credit, and microfinance exposures:³

• Body — violence, homicide, trafficking, and health burden; the most direct driver of mortality and morbidity claims.

• Family — household stability, non-marital birth rates, child marriage, and repayment/trust culture; the most direct driver of credit and microfinance default behavior.

• Authority — corruption, rule-of-law weakness, and institutional capture; shapes fraud risk, regulatory unpredictability, and claims-handling integrity.

• Coercion — distinguishes whether apparent social order is freely sustained or state-enforced; determines whether disorder is a brittle, suppressible political condition or an embedded structural one.³

Comparison Set

Mexico, Colombia, and Ecuador were selected as the three largest markets in the region currently framed as high-growth opportunities for life, health, and credit expansion, and because their divergent 2025–2026 headline crime trajectories (Mexico declining, Colombia mixed, Ecuador surging) provide a natural test of whether MDI structural scores track or diverge from conventional crime-based risk signals.

Quantitative Evidence

None of the three countries meets the MDI’s is_coerced threshold (coercion score ≥ 48 AND total score ≤ 50) — all three fall short on the coercion-score leg, despite Mexico and Colombia’s total scores clearing the total-score leg.³

Compliance and Sanctions Overlay

FATF

As of the June 19, 2026 FATF plenary, the grey list comprises 22 jurisdictions: Angola, Bolivia, Bosnia and Herzegovina, Bulgaria, Cameroon, Côte d’Ivoire, DRC, Haiti, Iraq, Kenya, Kuwait, Laos, Lebanon, Monaco, Nepal, Papua New Guinea, South Sudan, Syria, Venezuela, Vietnam, the British Virgin Islands, and Yemen; Algeria and Namibia were removed at this plenary.⁷ The blacklist remains unchanged at three jurisdictions: Iran, North Korea, and Myanmar.⁷ Mexico, Colombia, and Ecuador are not on either list. Notably, Bolivia and Venezuela — both in the same region — are on the grey list, showing that Latin America is not categorically exempt from FATF concern; Mexico, Colombia, and Ecuador’s clean status is a distinguishing, favorable formal signal, not a regional default.

FinCEN

On June 30, 2026, FinCEN issued Supplemental Alert FIN-2026-Alert003 on fuel smuggling and tax evasion schemes (”fiscal fuel theft”) tied to Cartel de Jalisco Nueva Generación (CJNG) and other Mexico-based transnational criminal organizations smuggling U.S. fuel into Mexico.⁸ The alert was issued the same day as a coordinated OFAC sanctions action against two Mexican nationals and nine entities spanning transportation, financial services, and real estate — sectors directly adjacent to consumer lending and microfinance branch networks.^8,14

OFAC / Sanctions

OFAC’s Latin America-related sanctions architecture is built around cartel and criminal-network designations rather than country-wide embargoes. The Sinaloa Cartel, CJNG, and Juárez Cartel are among 20 Latin American and Caribbean organizations now designated as Foreign Terrorist Organizations, and Treasury and State have added more than 380 Latin American individuals and entities to the SDN list, with the pace of designations accelerating since May 2026.^15,16 Ongoing SDN actions through mid-2026 continue to target Mexican cartel figures and their financial and logistics networks.¹⁶

Interpretation Rule

Mexico, Colombia, and Ecuador are not on the FATF grey list, and headline crime trends in Mexico are improving. Applied literally, an institutional compliance and macro screen would treat all three as clean or improving jurisdictions. The FinCEN/OFAC record shows this is incomplete: active, escalating enforcement against cartel-linked fuel smuggling, tax evasion, and financial-services front companies confirms that institutional compliance status materially understates ground-level criminal and financial-crime risk in at least the Mexican market, and by extension the MDI Authority sub-score (53.8, the highest of the three) is the more forward-looking signal than either FATF status or the declining homicide trend.

Quantitative Interpretation

Band Test

All three countries sit in the Critical band (44–49), one tier below Severe (≥50).³ This is materially above what a “high-growth, de-risking” narrative — particularly Mexico’s declining-homicide storyline — would imply. A Critical band classification signals disorder concentrated enough to be a first-order underwriting and credit variable, not a background macro consideration.

Category Concentration Test

Body and Family are the two largest drivers in all three countries, exactly matching the two sectors’ primary loss channels (mortality/morbidity and household/repayment stability). Colombia’s Body score (55.6) is the highest of the three and above the Critical-band average (39.4), driven in part by its still-elevated 25.8 per-100,000 homicide rate. Mexico and Ecuador both post Authority scores (53.8 and 53.2) near or above the Critical-band average (63.8), consistent with entrenched corruption and institutional capture independent of the crime trend in either direction. This concentration confirms the report’s sector selection: the drivers of the MDI score are the same drivers of claims and default risk, not tangential moral concerns.

Coercion Test

All three countries register Moderate-to-Low coercion (42.5, 31.3, 29.6), well under the 48-point threshold used to flag state-enforced order.³ The 195-country regression of Authority disorder on Coercion Score (R² = 0.67, slope = 0.97, p < 0.001, n = 195) shows that coercion typically rises in lockstep with authority disorder — yet Mexico, Colombia, and Ecuador all sit noticeably below the regression line for their level of Authority disorder (see Figure 2).² That gap means their disorder is not being artificially suppressed by state coercion; it is socially and structurally embedded — a form of disorder that is more durable and predictable for underwriting purposes than politically coerced “order” would be, but also less likely to improve through political liberalization alone.

Compliance Overlay Test

The FATF signal (clean) and the FinCEN/OFAC signal (active, escalating cartel-finance enforcement in Mexico) point in different directions. This is a criminal-network problem layered on top of, not replacing, an institutional-integrity problem: FATF measures a country’s AML/CFT regulatory framework, while FinCEN and OFAC are responding to what criminal networks are actually doing inside and through that framework. For Mexico specifically, the compliance overlay corroborates — rather than contradicts — the elevated MDI Authority score.

Decision Relevance Test

• Underwriting assumptions for Mexican life and health books should not be relaxed solely on the basis of the declining 2025 homicide trend; Authority-driven claims and fraud risk has not improved in parallel.

For B2C Readers

If your pension fund, mutual fund, or insurance provider holds Latin American life, health, or consumer-lending exposure, understand that a “growth market” pitch built on urbanization and rising incomes can coexist with structurally high rates of violence, family instability, and institutional corruption. Mexico’s falling homicide rate is genuinely good news, but it does not mean the underlying corruption and cartel-finance risk that shapes insurance costs and loan pricing has fallen with it.

For Investors

• Do not treat a declining national homicide rate as a broad de-risking signal; disaggregate by MDI category before adjusting country exposure limits, particularly for Mexico where Authority risk is stable-to-elevated.

• Widen the country risk screen beyond FATF status alone; incorporate MDI Total score and category concentration as a standing input for Latin American allocations.

• Treat Ecuador’s 2025–2026 homicide surge as a confirming, not surprising, data point — the MDI Body sub-score already signaled above-average risk before the crisis fully materialized.

Because coercion levels are Moderate-to-Low, this disorder is structurally embedded rather than a product of suppressible state repression, making it a durable rather than transient underwriting variable. Clean FATF status across all three countries is real and favorable, but the June 2026 FinCEN alert and coordinated OFAC action confirm that formal compliance clearance can understate active, ground-level financial-crime exposure — most acutely in Mexico, where a seven-year-low homicide rate has not been accompanied by any corresponding improvement in the MDI’s Authority score. Latin America’s growth markets are not a moral-panic story, but they are not a low-friction growth story either: they are a Critical-band structural risk that conventional macro and even improving-crime narratives will systematically underprice unless MDI category data and compliance typology alerts are used as standing inputs alongside GDP and penetration statistics.

The United States and Iran signed a peace deal on June 17, broke it on July 8, paused on July 24, and are currently negotiating, again. Six weeks. This is being described as a normal friction of post-war diplomacy…

Managed coercion. A failure to reach peace implies a preference towards peace but obviously no one can agree on the terms…obviously. But managing coercion means both parties are just putting up a front to appear to negotiate because its producing better outcomes than solving it.

Calibrated. The strikes are not maximized. The pauses are timed to mediator intent. Iran cleared just enough mines to claim it is compliant, then stopped. The US struck enough targets to demonstrate it’s capability, then stopped. What were both sides doing? They were improving their negotiating position.

The cost of this malfunctioning management is on the humans. The 400,000 Sudanese whose medicines were stranded in Dubai for four months, paid. The sailors on 400-500 ships that could not transit the Gulf, paid. The economies that absorbed energy price spikes, paid. Do they get a room at the Burgenstock hotel for the next “agreement”?

The UN found something, and then…

On July 10, the UN mission determined genocide is being carried out by the Rapid Support Forces in El Fasher. The mission used the word “overwhelmingly” as its legal threshold in the report. The ICC separately announced evidence of RSF Deputy Commander Abdelrahim Hamdan Dagalo to war crimes in Darfur. He is not under arrest. The UAE, which has been the RSF’s primary external arms supplier faces no sanction.

On July 24, the RSF attacked the Berber area south of el-Obeid. The UN had warned for weeks that el-Obeid was the RSF’s next target. The RSF attacked anyway.

Not one ‘determination’ produced an arrest, a weapons cutoff, or a change in RSF behavior. Why? China and Russia vetoed stronger Security Council action on Sudan. The UAE has close economic and political relationships with member states voting.

The word ‘ceasefire’ is no longer defined

The ceasefire framework for Gaza has been in place since October 2025 yet 1,180 Palestinians have been killed. Israel controls approximately 70 percent of the Gaza Strip and was recently directed to reach 100 percent.

On July 26, Israel’s security cabinet allowed a limited international stabilization force into a narrow Gaza pocket. Experts who reviewed the plan described it as designed to appear compliant with the US peace plan. But the requirement in the plan is a full multinational deployment. Optics of compliance with no change in reality.

Hamas dissolved its government the US peace plan required to exist in order to receive transferred civilian authority. So now the plan has no recipient on the Palestinian side. Negotiations appear to be calibrated to politics and have nothing to do with the survival needs of Gazans.

Famine? don’t care

Save the Children reported on July 7 that children in Jonglei state are surviving on leaves and water lilies pulled from swamps. Mothers are walking hours through floodwaters to find anything edible.

South Sudan has a famine because armed groups are conducting military operations in the vicinity of humanitarian supply chains. 700,000 children have severe acute malnutrition. 2.2 million children need malnutrition treatment. WFP is providing 50 percent of daily caloric requirements only to children it can reach.

This is a downstream product of decisions. No accountability. Nor any strategic recalculation that produced them.

The world does not lack in institutions to address any amount of atrocity. The ICC exists. The UN Security Council exists. Arms embargo regimes exist. Ceasefire monitoring frameworks exist. Humanitarian law exists.

These institutions produce determinations. Words. Of genocide, indictments, ceasefire agreements, condemnation resolutions. Those determinations do not result in enforcement. Top Russian leadership and military command is under ICC indictment. Nothing happens. The RSF is committing genocide per the UN. Nothing happens. Israel is violating a ceasefire by its own signature. Nothing happens.

Why nothing? Because enforcement requires imposing costs on allies, trading partners, or veto holders. “High costs”.

Reform it? They have been reformed repeatedly over 80 years.

The real answer? Realign national “strategic interests” to answer to morality.

The people paying for it don’t get a say.

The National Labor Relations Board and New York agreed Monday to end the federal challenge over New York’s 2025 labor law. The law had let the state labor board take private-sector union cases when the federal board had too few members. A federal court in Brooklyn first blocked that state route in November, then struck the law down for good, and the federal case ended after New York accepted that result.

On July 21, a federal oversight report disclosed that EPA had not awarded roughly 44 percent of its 2022 and 2023 water-project funds by September 2025. That left more than $1 billion across 510 of 1,198 drinking water, wastewater, stormwater, and water-quality projects unused for their stated purpose. Every one of these projects had been approved by Congress.

The EPA attributed this delay to a new program, staff shortages, and inexperienced recipients. They also identified missing goals, scattered tracking, and unclear guidance for consulting tribal governments.

If we added battlefield events to the MDI, wars would overwhelm the slower changes the index is tracking. We would also risk counting the same disorder twice and blaming invaded countries for decisions made by their attackers.

What the MDI measures

The MDI measures the moral conditions of daily life in all 195 nations. It draws on 17 independently collected primary-source datasets across seven domains: Body, Family, Sacred, Truth, Authority, Sovereignty, and Creation. In each country, we ask: What is it like to live here, morally?

Can you speak the truth without fear? Will a court judge your case following rule of law? Are marriage and family holding together? Can you change your religion and live openly?

The MDI is not a grading of a government. A government may send troops across a border, defend its territory, or support a foreign war. These are not the same as the conditions its people face at home.

War moves too fast.

The MDI tracks changes that usually take years: laws change, courts lose independence, families break down, officials normalize coercion, and governments gain control over what people may say. War can begin in days. Front lines can move in hours. A ceasefire can change the picture again.

If we added battle deaths, airstrikes, or territorial gains to the MDI, the score would rise and fall with the news. The war would drown out the slower changes underneath it, and you would lose everything.

The MDI may already show the disorder that led to war

Aggressive states often reveal their character before they invade anyone. They silence critics, corrupt courts, punish dissent, manufacture public truth, and concentrate power. The MDI already scores those conditions.

If the same government later attacks a neighbor, adding the war to its MDI score may count the same underlying disorder again. It would also hide one of the index’s most useful findings which is the internal warning signs were visible before the attack.

A war score would punish the country under attack

Suppose an invasion automatically raised the invaded country’s MDI score. That country would appear more morally disordered just because a foreign ruler chose to attack it. Many may risk their lives to defend their families and neighbors.

Such a score would tell us where violence is occurring. It would not tell us which society is morally disordered or who caused the war. Who caused or why is also a tricky question to answer and in cases takes decades to fully flush out.

When conflict does affect the MDI

A long war can become part of daily life. When courts no longer function, the government loses control of its territory, armed groups replace civil authority, and people can no longer rely on basic public order, the MDI records that breakdown in the Sovereignty domain. State failure, civil war, and ungoverned territory make up a portion of the Sovereignty score.

War can also change other scores over time. It may break families, destroy trust, increase coercion, or weaken courts. The MDI records those changes when the underlying data show that daily conditions have changed and persisted longert han a single event.

What the MDI can show about aggressive regimes

The MDI can show conditions that make aggression easier: rulers who rely on coercion, governments that control public truth, and institutions that cannot restrain those in power.

The Coercion Index adds another distinction. It separates countries where people freely uphold moral order from countries that appear orderly because the state forces compliance.

Why conflict has its own index

War matters too much to force into a measure that was not for it. The Global Conflict Index tracks conflict directly. It can move as events move and can be updated on the schedule of war. The GCI Pulse reports those changes each week.

The MDI asks: What moral conditions do people live under? The GCI asks: What violence is happening now?

Combining them would make both answers less clear.

Wagner’s Political Economy, Briefly

Wagner became operational in CAR in 2017 under a formal mandate of roughly 175 military trainers; by 2021 it was fighting alongside government forces, with troop levels reaching around 1,500 personnel by early 2026.¹ Rebranded in 2023 following Yevgeny Prigozhin’s death, the group now operates under Russia’s Ministry of Defense and GRU. OFAC designated Wagner a transnational criminal organization on January 26, 2023, sanctioning affiliated firms for illicit mining, illegal trade, and human rights abuses.²

Wagner’s durability rests on what Christopher Spearin calls “concessionary politics”: resource extraction financing payoffs to President Faustin-Archange Touadéra and the ruling elite while the state itself remains deliberately underdeveloped.⁵ In exchange for security and political protection — most recently, help delivering Touadéra’s disputed third-term election in December 2025 with 76–78% of the vote after removal of constitutional term limits^9,1 — Wagner embedded itself across CAR’s military, intelligence, and economic structures, controlling assets like the Ndassima gold mine and laundering proceeds through UAE-linked structures and shell firms such as Midas Resources, Meroe Gold, Lobaye Invest, and Diamville.^3,6,4 Proxy militias — the “Black Russians,” the “Sharks,” and Azandé Ani Kpi Gbé (AAKG) — extend Wagner’s reach through bribery, extortion, and violence.

Measuring the Damage: CAR Through the Moral Disorder Index

The Wagner Group thesis describes a mechanism. The Moral Disorder Index describes the structural terrain that made the mechanism so effective. CAR currently ranks 7th out of 195 nations on the MDI, with an overall score of 49.3 — placing it in the “Critical” band, one step below the worst-performing tier globally.⁷ The country also carries a Coercion flag, meaning a meaningful share of its apparent order is enforced compliance rather than freely chosen social stability.

Three observations from this profile matter directly for policy design.

First, Authority disorder is the dominant driver of CAR’s score, and it is the same disorder Wagner monetizes. A score of 70.1 — CAR’s highest sub-score by a wide margin — is the quantitative signature of exactly the “concessionary politics” the original thesis describes: an elite that treats public office and resource concessions as instruments of personal enrichment. This means that policy aimed only at removing Wagner’s boots on the ground, without addressing the underlying corruption architecture, will simply create a vacuum for the next external patron.

Second, CAR’s Truth disorder (44.5) is not incidental — it is Wagner’s information-operations infrastructure showing up in the data. Russia has financed newspapers, billboards, films, and social media networks in CAR to discredit domestic opposition and Western actors while glorifying the regime.⁵ The MDI’s Truth score is, in effect, a partial measurement of how successful that campaign has been at corrupting CAR’s information environment.

Third, and most important for both US policymakers and investors: CAR’s Coercion flag means its overall stability should be read with real caution. The MDI’s Coercion Index exists precisely to distinguish genuine social order from order manufactured through fear and state enforcement. CAR’s Coercion Score of 54.8 (”Elevated — significant state enforcement shapes moral behavior”) signals that whatever surface stability accompanied Touadéra’s third-term consolidation — a boycotted opposition, a disputed election Russian officials publicly took credit for helping secure, and a security apparatus built on foreign mercenaries — is not the same thing as durable institutional legitimacy.^8,9 This is the analytical bridge between the MDI and the Wagner thesis: Africa Corps does not merely exploit CAR’s disorder — it actively manufactures a coerced substitute for order, which is precisely why its removal without institutional reform risks immediate relapse rather than genuine stabilization.

A caveat worth flagging honestly: CAR’s Sovereignty sub-score (26.0) reads as comparatively low-disorder relative to the country’s other categories, which may understate the operational reality on the ground. Fighting between government forces and the Wagner-trained-then-defected AAKG militia intensified in Haut-Mbomou prefecture immediately after the December 2025 election, disrupting voting, and cross-border dynamics with South Sudan and Sudan continue to strain state control in the southeast.¹⁰ The gap between the index’s formal sovereignty indicators and the lived security environment is itself a useful signal: it illustrates why any single index — including the MDI — should be read alongside conflict and security reporting, not as a substitute for it.

The 2026 Inflection Point

Several developments now underway make CAR a live test case rather than a static problem:

• Moscow is trying to force a costly transition. Russia is pressing Bangui to replace the self-funded Wagner model with the Ministry of Defense-run Africa Corps, which demands direct cash payment for security services CAR cannot easily afford — a demand Touadéra has so far resisted, preferring to pay in mineral concessions.^11,12

• Wagner’s proxy militias are turning on the state that hosted them. The AAKG’s 2026 insurgency in the southeast is a textbook case of “proxy blowback” — a Russian-armed local force that lost command discipline over unpaid wages and is now destabilizing the very regime Wagner was hired to protect.¹⁰

• France and the UN are re-engaging, but funding is thin. Paris resumed budgetary support (€35 million between late 2024 and late 2025) in exchange for reduced anti-France disinformation, while the UN’s MINUSCA mission is more than 60% underfunded — $733 million of its $1.17 billion annual budget unpaid as of February 2026.^9,13

• The UN Security Council is set to renew CAR sanctions through July 2027, maintaining the arms embargo on armed groups and the Panel of Experts monitoring illicit resource flows.¹⁴

Policy Recommendations

The original article’s three policy directions remain sound and should anchor US strategy — with two structural additions informed by the MDI’s Authority and Truth findings.

1. Tie all assistance to verifiable anti-corruption benchmarks. Rather than delivering aid unconditionally to the presidency, US and multilateral support should be conditioned on transparent mining licensing, an independent oversight mechanism for extractive resources, and published budgets. This directly targets the Authority disorder (70.1) that is CAR’s dominant structural weakness and the mechanism through which Wagner buys elite loyalty.

2. Invest in independent local media and counter-disinformation literacy. Contesting the domestic information space that Wagner-funded outlets currently dominate is the most direct way to lower CAR’s Truth disorder score and reduce Moscow’s ability to shape domestic political narratives ahead of future elections.

3. Coordinate US, UK, and African Union enforcement against sanctions-evasion networks — including downstream buyers, not just individuals. Wagner-linked companies (Midas Resources, Meroe Gold, Lobaye Invest, Diamville) rebrand and evade embargoes; fragmented enforcement lets them succeed. Policy should target refiners, transit hubs, and offshore buyers — with particular attention to UAE-based intermediaries — closing the pathways that convert CAR’s resources into hard currency for Moscow.^4,5

4. Underwrite CAR’s EITI corrective-action plan and mining cadastre, rather than treating transparency reform as a side issue. CAR’s 2024 Mining Code requires beneficial-ownership disclosure and EITI/Kimberley Process compliance, but the country was suspended from EITI in November 2024 after scoring “low” (39/100) on transparency, with the Board explicitly flagging concerns about mining rights awarded to companies affiliated with the government’s paramilitary security contractors in exchange for services.¹⁵ US technical and financial support for the beneficial-ownership registry and licensing cadastre — administered through GEMINCA, the state monitoring body — would simultaneously de-risk the sector for legitimate investors and expose the Wagner-linked concession structure to public scrutiny.

5. Help close CAR’s security-financing gap so Bangui has an alternative to paying Moscow in minerals. With MINUSCA underfunded by over 60% and Russia demanding direct cash payment for Africa Corps deployment that Touadéra cannot afford, the US and partners have genuine leverage. Backing MINUSCA’s budget, supporting demobilization of AAKG and other Wagner-origin militias, and offering conditioned security-sector-reform assistance gives Bangui a credible off-ramp from a financing arrangement it may not even want to keep.

What International Development Investors Need to Know About CAR

CAR’s MDI profile and its investment climate are two views of the same underlying reality — investors weighing entry should read both together.

• Political risk is elevated and coercion-linked. Touadéra secured a third term in December 2025 after removing constitutional term limits, with the opposition boycotting and Russian officials publicly claiming credit for the security conditions that made the vote possible.^16,9 The MDI’s Coercion flag on CAR is a direct warning that current political stability is manufactured rather than institutional, and could prove brittle if security-force loyalties shift — as they already have with AAKG.

• Legal and regulatory transparency is improving on paper, weak in practice. The 2024 Mining Code requires EITI and Kimberley Process compliance and beneficial-ownership disclosure, but CAR remains under an EITI corrective-action plan after its November 2024 suspension, and government agencies lack the IT systems to produce reliable production and export data.^17,18 Investors should expect a multi-year gap between the law on the books and enforceable transparency.

• Sanctions exposure is a live counterparty risk, not a theoretical one. Any investor entering CAR’s mining, timber, or logistics sectors must conduct enhanced due diligence to avoid co-mingled supply chains touching OFAC-designated Wagner-linked firms (Midas Resources, Meroe Gold, Lobaye Invest, Diamville) or their successor entities. Sanctions evasion runs through shell structures and UAE-based intermediaries, so second- and third-tier counterparty screening matters as much as direct relationships.^2,3

• Geography determines risk-adjusted opportunity. The World Bank identifies high-grade gold deposits in the relatively stable, better-connected western part of the country as the most viable near-term entry point, given gold’s high value-to-infrastructure ratio.¹⁹ By contrast, the southeast — particularly Haut-Mbomou — is actively contested by the AAKG insurgency and should be treated as a no-go zone for the foreseeable future.¹⁰

• Macro fundamentals are modest but improving. Real GDP growth is forecast at 2.1% (2025), 2.2% (2026), and 2.8% (2027), driven by agro-processing and services, contingent on energy access and continued donor concessional funding.¹⁹ A July 2026 World Bank report calls for urgent public-finance reforms — domestic revenue mobilization, debt management, procurement transparency, and donor-coordination — as preconditions for translating resource wealth into broader growth.²⁰

• There is a viable US-backed model to adapt. The US-DRC Strategic Partnership Agreement — pairing Development Finance Corporation (DFC) capital with a critical-minerals framework, preferential access for vetted US companies, and government transparency commitments — offers a template Washington could scale down for CAR’s gold sector, using conditioned DFC financing to reward exactly the transparency and anti-corruption reforms recommended above.^21,22

The Strategic Convergence

The central insight the MDI adds to the original Wagner thesis is that countering Russian influence and improving CAR’s investment climate are not two separate US objectives competing for resources — they are the same project. Wagner’s leverage in CAR is built almost entirely on exploiting CAR’s Authority disorder (corruption) and Truth disorder (disinformation). Every dollar of US assistance that strengthens transparent licensing, independent media, and enforceable beneficial-ownership rules simultaneously weakens the mechanism Wagner depends on and lowers the risk premium legitimate investors currently price into any CAR opportunity. Conversely, a purely security-focused counter-Wagner strategy that ignores the underlying Authority and Truth disorders — treating CAR’s stability as a problem of troop numbers rather than institutions — will simply reproduce the conditions for the next external patron, whether Russian, or otherwise, to exploit.

Most writing in stops there and lets the reader assume the failures are representative. We think that assumption is the worst move in risk analysis, so we did a little more work. For each of the historical cases, we built a full cohort: every comparable entity carrying comparable exposure at the same starting date, selected by criteria we fixed in advance, before looking at outcomes. Then we followed everyone through time, including the firms nothing happened to, and coded each one at its worst outcome. Nothing (X0). Minor penalties (X1). A hit material to the entity, a forced exit, a multi-year constraint (X2). Bankruptcy, franchise death, expropriation (X3).

Five cohorts. Forty-one entities. To find out how often. Here is what the denominators say.

Nine for nine

Start with opioids. In May 2007, the month Purdue’s operating company plead guilty to federal misbranding charges, nine companies had material revenue from manufacturing or distributing prescription opioids: Purdue, Endo, Mallinckrodt, Johnson & Johnson, Teva, Allergan, and the three big distributors, McKesson, Cardinal Health, and AmerisourceBergen.

Follow all nine for eighteen years. Every one of them paid at the material level or worse. Nine for nine.

Three died or nearly did. Purdue: bankruptcy and dissolution. Endo: Chapter 11 plus a $1.086 billion criminal fine. Mallinckrodt: two bankruptcies and a $1.7 billion settlement obligation. The other six wrote large checks: about $5 billion and a forced exit from the US opioid business for Johnson & Johnson, $4.25 billion for Teva, $2.37 billion for Allergan, and $6.86 billion, $5.56 billion, and $5.58 billion for the three distributors, paid out over roughly eighteen years.

One more company entered this same trade but only after after our starting date, so it does not count in the nine. But the consequences were still there. Insys Therapeutics launched a fentanyl spray in 2012. Seven years later it was bankrupt, dissolved, and its founder was in federal prison.

For this cohort, in this window of time, a material happened to all. The only thing that varied was severity. The companies that were nothing but opioids went bankrupt. The diversified majors and the distributors wrote checks and survived.

Twenty percent

Now the contrast cohort, and the most important finding in this study.

We assembled ten cases from industries with documented public costs: the tobacco majors, three firearms makers (Remington, Smith & Wesson, Sturm Ruger), Coca-Cola and PepsiCo, Anheuser-Busch and Diageo, Caesars and MGM. Same fragility family as the opioid cohort. Comparable exposure on paper. Followed for thirty-one years.

Two of the ten took a material hit.

This wasn’t moral luck. It was just legal statute. In 2005, Congress passed the Protection of Lawful Commerce in Arms Act, which blocked states from running the tobacco playbook against gunmakers. In 2004, the House passed the “Cheeseburger Bill”, and state versions followed, shielding food companies from obesity recovery suits. Nobody ever found a good way to sue alcohol or gambling industries. The obesity suits against Coca-Cola and PepsiCo were dismissed. Caesars’ $18 billion bankruptcy was a leverage story, not a recovery of the harm.

The exception. Remington still died: two bankruptcies and a $73 million Sandy Hook settlement. A blocked channel to capture the full weight of the moral harm is just a political fact. A statute that blocks recovery can be repealed. The exposure is still there seeping.

Put the two cohorts side by side and what separated them was whether a working legal tool existed. Opioids faced one, inherited from tobacco. Firearms and food had Congressional protection. Whoever prices this class of risk on exposure alone will be wrong.

The certain layer

Seven US retail banks carried documented aggressive-sales or consumer-abuse cultures by the mid-2010s: Wells Fargo, TD Bank’s US operation, Santander Consumer, Bank of America, Regions, U.S. Bank, Fifth Third. Over twelve years, every single one of them paid regulatory penalties for it. $250 million, $191 million, $37.5 million, $20 million. Three of the seven took structural hits: Wells Fargo’s seven-year asset cap, TD’s $3.09 billion in penalties, guilty plea, and its own asset cap, and Santander’s roughly $550 million 34-state settlement.

The same appears in adult-content platforms after the card networks cut off Pornhub in December 2020. Six major platforms; five years; every one of them ended under penalty or restriction. Texas settlements, EU designations and minor-protection proceedings, state-by-state access blocks. The Supreme Court solidified it upholding Texas’s age-verification law in June 2025.

An event that happens to everyone is not a risk scenario. It is an operating cost. Companies with this cultural profile should carry the minor-penalty layer as an expected expense, the way a trucking company carries fuel. Treating it as a probability-weighted scenario understates a cost that reliably arrives. Save the scenario weights for the material tier, which hit roughly a third to two-fifths of the bank cohort in twelve years.

Who takes the worst outcome is not random. Six platforms carried near-identical category exposure. One of them carried a documented record of non-consensual content failures its competitors did not. That one took the terminal outcome; the other five took penalties and constraints. Same pattern as opioids, where the pure plays died and the diversified survived.

The flag and the precedent

Next: nine jurisdictions that held large stocks of foreign capital around 2010 under governments whose stability rests on coercion. Russia, Venezuela, Myanmar, China, Belarus, Kazakhstan, Saudi Arabia, Turkey, Vietnam.

Fifteen years later, six of the nine had forced material losses on foreign capital. Russia’s seizure decrees and more than $167 billion in foreign losses. Venezuela’s uncompensated expropriations and an $8.7 billion arbitration award. Myanmar’s post-coup forced exits, with Telenor’s unit sold for $105 million under junta steering. China’s tutoring ban, which stranded foreign investors in a sector worth around $100 billion. Belarus’s disposal freeze on 190 companies. Kazakhstan’s claims of up to $150 billion against the Kashagan developers.

We checked our own index against the cohort. All nine jurisdictions, the ones that hit foreign capital and the ones that did not, carry the coerced flag in the current Moral Disorder Index run. The coercion flag caught every jurisdiction that seized or stranded foreign capital.

Turkey and Vietnam carry the same flag, and nothing happened to foreign capital there in this timeframe. Vietnam, flagged, grew its realized FDI stock past $300 billion, and the US government’s own investment-climate reporting found no expropriations of foreign investment there.

What does separate the worst outcomes is precedent. Of the nine, exactly two had expropriated foreign or major domestic capital before our 2010 starting date: Russia (Yukos, 2003) and Venezuela (the 2007 wave). Both went terminal.

Bands, not points

Here is what we will not do with these numbers.

The cohorts are small: six to ten members each. The statistical intervals around a frequency like 9 of 9 or 2 of 10 are wide. Each cohort is also one draw of history: the nine opioid outcomes were correlated with each other, produced by one litigation wave, not nine independent coin flips. And the cohorts were assembled in 2026 by analysts who know how the stories ended. We fixed membership criteria before coding outcomes, which is the available discipline, but retrospective work cannot be fully blinded.

We have a forward fix of applying the same coding to entities whose outcomes are not yet known.

These are measured probabilities moving an assessment’s starting point. They do not decide its conclusion, and they are stated as ranges in everything we produce. What they replace is worse: gut feeling, or the silent assumption that the famous failures are the whole story.

Knowing which world you are in is worth a great deal of money, and the only way to know is to follow everyone.

The claim that “everyone has different morals” is one of the most widely repeated but empirically unsupported positions in contemporary discourse. When examined rigorously, the evidence from evolutionary biology, developmental psychology, cross-cultural anthropology, moral neuroscience, and clinical psychology converges on a single conclusion: human beings share a deep, biologically grounded moral substrate consistent across individuals, cultures, and epochs.

What appears to be moral diversity is almost always a surface disagreement rooted in differing facts, priorities, or circumstances — not a fundamental divergence in core values. The behavioral and clinical literature further demonstrates that when people invoke the “everyone has different morals” argument, they are frequently activating well-documented psychological mechanisms of rationalization and moral disengagement — cognitive tools the mind uses to justify pre-existing disorders of behavior while bypassing moral standards the individual already knows and accepts.

Part I: The Empirical Case for Universal Moral Foundations

1.1 Cross-Cultural Anthropology — The Seven Cooperative Morals

The most direct empirical test of universal base morality comes from systematic cross-cultural research. A landmark 2019 study by Oliver Scott Curry and colleagues at Oxford University applied the “morality-as-cooperation” framework to the ethnographic records of 60 human societies drawn from every region of the world. The findings were unequivocal: the moral valence of all seven cooperative behaviors — helping kin, reciprocating favors, deferring to authority, demonstrating bravery, and others — was uniformly positive across every society examined. The study concluded these constitute plausible candidates for universal moral rules.

Disagreement over how to apply a shared value is only possible if both parties share the underlying value as a reference point. The Stanford Encyclopedia of Philosophy’s entry on moral disagreement acknowledges this precisely: many apparent moral disagreements stem from factual errors, cognitive biases, or incomplete information rather than from genuinely different foundational values.

1.2 Infant Developmental Psychology — Moral Preferences Before Socialization

If morality were entirely a cultural construction, no preference for prosocial behavior should exist before cultural learning has occurred. In a foundational 2007 study published in Nature, Kiley Hamlin, Karen Wynn, and Paul Bloom at Yale’s Infant Cognition Center demonstrated that 6- and 10-month-old infants — preverbal and well before meaningful socialization — preferred individuals who helped others over those who hindered them.

A 2025 study from the University of British Columbia pushed this further, demonstrating that infants just five days old can distinguish between prosocial and antisocial interactions. A large-scale replication — the ManyBabies4 project, involving 567 babies across 37 labs on five continents — found the original effect was smaller than initially reported, a legitimate finding that demands intellectual honesty. It does not, however, negate the five-day-old findings or the broader body of developmental and cross-cultural evidence.

1.3 Moral Neuroscience — The Hard-Wired Moral Brain

The neurobiological evidence adds a structural dimension. A review published in CNS Spectrums by Mario F. Mendez (2009) at UCLA concluded that “morality may be innate to the human brain” and identified a “neuromoral network” centered in the ventromedial prefrontal cortex (vmPFC). When this network is damaged through stroke, tumor, or trauma, patients show “attenuated emotional reactions to the possibility of harming others” and may perform sociopathic acts as a direct result — strongly supporting that this architecture is a biological endowment, not a cultural one.

A 2026 study in Cell Reports identified the vmPFC as specifically involved in moral inconsistency — the gap between moral judgment and moral behavior. When the vmPFC was artificially stimulated, participants became more morally inconsistent. This demonstrates that moral knowledge and moral behavior are neurologically dissociable: a person can know something is wrong and still do it, not because their morality differs, but because the neurological bridge between judgment and action has been bypassed.

1.4 James Q. Wilson’s Synthesis — Four Universal Moral Pillars

Political scientist James Q. Wilson’s 1993 book The Moral Sense remains one of the most thorough scholarly treatments of this question. Drawing on extensive anthropological, psychological, and evolutionary evidence, Wilson argued that the moral sense is innate — acquired through evolution rather than cultural learning alone. He proposed four foundational pillars shared across cultures: sympathy, fairness, self-control, and duty. These map directly onto Jonathan Haidt’s independently derived Moral Foundations Theory — two research traditions, using entirely different methods, converging on the same foundational categories.

Part II: Why “Everyone Has Different Morals” Is a Misreading of the Evidence

2.1 Surface Disagreement vs. Deep Value Convergence

The most common intellectual error is conflating disagreements about the application of moral values with disagreements about the values themselves. These are categorically different things. Two cultures may disagree about whether a specific ritual practice is morally permissible — but if both agree that protecting children from harm is morally obligatory and their disagreement is about whether the practice causes harm, their moral foundations are identical. The disagreement is empirical, not moral.

C.S. Lewis made this argument with particular clarity in Mere Christianity: if people genuinely disagreed about fundamental values, they could not argue about morality at all — because argument presupposes a shared standard by which better and worse arguments can be assessed.

2.2 The Self-Refutation of Moral Relativism

The “everyone has different morals” claim, when used to deflect judgment, is logically self-defeating. The structure runs: morality is subjective, therefore your moral judgment of my behavior has no authority over me. But that second step is itself a moral claim. “You should not impose your morality on me” asserts an objective moral obligation that binds the other person regardless of their framework.

If moral relativism is true, “You have no right to judge me” is itself merely a subjective preference with no binding force — which completely undermines the very purpose for which the argument is deployed. A consistent moral relativist cannot assert that moral relativism is a superior position. The position cannot be held coherently.

2.3 Haidt’s Moral Dumbfounding — What It Actually Shows

Jonathan Haidt’s research on “moral dumbfounding” — in which people maintain confident moral judgments even when they cannot articulate reasons for them — is sometimes misread as evidence that morality is arbitrary. This reading is incorrect. Moral dumbfounding shows that moral judgments precede moral reasoning, not that they are baseless. The intuitions themselves are the product of deep evolutionary and developmental processes, remarkably consistent across individuals and cultures — and replicated in Chinese and Indian samples as well as Western ones.

Part III: The Real Function of “Everyone Has Different Morals” — Rationalization and Moral Disengagement

3.1 Albert Bandura’s Moral Disengagement Framework

Stanford psychologist Albert Bandura documented with precision how people who possess moral standards — and know they possess them — selectively neutralize those standards when they conflict with self-interest. Bandura is explicit: “Moral disengagement involves a process of cognitive re-construing or re-framing of destructive behavior as being morally acceptable without changing the behavior or the moral standards.” The standards remain in place. The behavior remains in place. What changes is a set of cognitive re-framings that create the subjective experience of consistency between them. This is not moral diversity. It is moral evasion.

The mechanisms include: Moral Justification (reinterpreting harmful behavior as serving a higher purpose); Displacement of Responsibility (attributing personal harmful actions to external causes); Diffusion of Responsibility (framing harmful behavior as collective); and Dehumanization and Victim Blaming. The claim that “everyone has different morals” functions as a pre-emptive cognitive mechanism that neutralizes anticipated guilt by redefining moral standards as arbitrary.

3.2 Post-Hoc Rationalization as Moral Escalation

Research published in Frontiers in Psychology (2020) experimentally tested whether post-hoc moral rationalizations after an unethical act influence subsequent behavior. Across three studies, generating moral rationalizations for prior immoral acts caused subsequent continuation and escalation of that behavior, particularly among individuals with weaker moral identity. Research by Shalvi and colleagues similarly documented “self-serving justifications” that allow individuals to “do wrong and feel moral.” The invocation of relativism is a textbook pre-violation justification that neutralizes anticipated guilt before the behavior occurs.

3.3 Moral Licensing — When Past Goodness Licenses Present Wrong

A meta-analysis of 91 studies (Blanken et al., 2015) confirmed that after prior acts of moral goodness, people experience reduced guilt about subsequent unethical behavior — as if they have accrued sufficient “moral credit.” When someone argues “I am a good person overall, so my behavior here is not that bad,” or invokes moral relativism to excuse a specific action, they are executing a licensing strategy rather than expressing a coherent moral philosophy.

3.4 Empirical Evidence That Moral Relativism Directly Enables Immoral Behavior

This is among the most striking findings in the literature: exposure to moral relativism itself causally increases immoral behavior. In two studies published in the Journal of Experimental Social Psychology (2013), Rai and Holyoak at UCLA demonstrated that participants who read a relativist argument were more likely to cheat in an incentivized raffle than those who read an absolutist argument. The researchers concluded that relativism’s framing of morality as “subjective and culturally-historically contingent… makes individuals more likely to engage in immoral behaviors.” This is a direct, causal, experimentally demonstrated relationship.

Part IV: The Psychopathy Case — Knowing Right From Wrong Without Caring

4.1 What Psychopathy Actually Tells Us

A 2010 study published in Social Cognitive and Affective Neuroscience by Cima, Tonnaer, and Hauser directly tested the assumption that psychopaths are immoral because they lack moral knowledge. The finding: psychopaths make the same moral judgments as healthy individuals. The researchers concluded that “psychopaths understand the distinction between right and wrong, but do not care about such knowledge.” The failure of psychopaths is not a failure of moral understanding. It is a failure of moral motivation. The person who claims “everyone has different morals” to justify harmful behavior is, in most cases, not displaying a genuinely different framework — they know the standard and are choosing not to be bound by it.

4.2 The vmPFC and Moral Inconsistency

The 2026 Cell Reports study demonstrated that decreased vmPFC activity correlates with behaving dishonestly while simultaneously judging the same behavior as immoral in others. This is the neural signature of moral hypocrisy rather than moral difference. The person who claims “my morals are different” and then expresses outrage when the same standard is applied to them is not operating from a genuinely different framework — they are demonstrating that the framework they claim not to have is operative and simply being applied selectively.

Part V: The Distinction Between Moral Knowledge and Moral Order

5.1 Having Morals vs. Ordering Them Properly

A critical distinction in this analysis is between possessing base moral intuitions and ordering them correctly. The research demonstrates that humans universally possess core moral intuitions: care for those who are harmed, concern for fairness, recognition of duty and loyalty, and a sense of sanctity or dignity. What varies across individuals, cultures, and times is not the presence of these intuitions but their weighting and ordering.

A doctoral study from the University of Sheffield on the psychology of moral disagreement concluded that disagreement arises from “differing in the amount of normative weight that they assign to distinct values.” Both parties share the same moral vocabulary. They differ in how they balance competing values when those values conflict. This is fundamentally different from the “everyone has different morals” claim, which implies the moral categories themselves differ. They do not. Crucially, weightings can be evaluated — one can ask whether a given priority ordering produces harm, is self-serving, or is applied consistently.

5.2 Disorder vs. Difference

The language of disorder is precisely appropriate here. A person who consistently prioritizes their own interests over the care and safety of others is not operating from a coherently different moral framework. They are exhibiting a disordered application of a shared framework. Clinical psychology has extensive, well-documented categories for these patterns — narcissistic personality disorder, antisocial personality disorder, and various cluster-B patterns all involve systematic distortions of moral regulation, not the absence of moral content, but the dysregulation of its application.

Part VI: What Genuine Moral Disagreement Actually Is

6.1 The Legitimate Forms of Disagreement

Intellectual honesty requires acknowledging that genuine moral disagreement exists and is not always reducible to rationalization. The philosophical literature distinguishes three types: resolvable (arising from factual errors or biases), persistent (arising from different weightings of shared values), and deep (arising from fundamentally different epistemic frameworks). Deep moral disagreements are real but rare — and even in these cases, the parties typically share a large common ground of basic values.

The hallmark of genuine moral disagreement is that both parties hold their positions consistently, apply them impartially, and engage seriously with counter-arguments. The hallmark of rationalized moral disengagement is that the “moral difference” argument appears selectively — precisely when personal interests are threatened — and disappears when the person is harmed by others.

6.2 Moral Progress Requires Moral Objectivity

The concept of moral progress — including the abolition of slavery and the expansion of rights — is logically incoherent under moral relativism. If morality is merely subjective and culturally determined, there is no basis on which slavery could be declared wrong across cultures and times. The abolition of slavery was not merely a change in moral fashion. It was the recognition of a truth about human dignity that was always real, always binding, and always violated by the institution in question. Progress requires a fixed standard by which movement can be measured. Relativism, by abolishing the standard, abolishes the possibility of progress altogether.

Conclusion

The claim that “everyone has different morals” does not withstand rigorous scrutiny. The empirical record from cross-cultural anthropology, infant developmental psychology, moral neuroscience, and clinical psychology consistently supports the conclusion that human beings share a deep, biologically grounded moral substrate consistent across cultures, developmental stages, and neurological architectures.

What appears to be moral diversity is almost always one of three things: factual disagreement about circumstances applied to shared values; different prioritization of values that both parties hold; or motivated rationalization — the deployment of a philosophical claim in service of avoiding accountability for behavior the individual already recognizes as disordered.

The sophistication required to rationalize wrongdoing is evidence of the moral standard being evaded, not proof that it was absent. The universal moral grammar humanity shares is not undermined by its misuse. It is confirmed by the effort required to evade it.

On July 13, the SEC published an action against Battle Motors and its chief executive, Michael Patterson, over a $112.5 million debt raise. The agency said they told two investors the company had 115 electric-vehicle purchase orders worth $30 million in three months. It said only eight orders, about $2 million in sales, existed then; the rest were expressions of customer interest.

Battle Motors and Patterson agreed to resolve the matter without admitting the claims, so the record supports the filed claims and proposed penalties, not a finding of personal intent.

The pattern:

This is not a simple mismatch between optimism and outcome. The reported structure moved interest into the accounting column reserved for orders. It also expanded a dealer network from 47 dealers and 156 locations to 180 dealers and 320 locations. Investors were shown institutional scale before the company had it. The gap sits in the translation layer, where possibility became reported capacity.

Why it matters:

The moral wrong is converting commercial possibility into present fact to obtain trust and capital. Markets can price risk, but they cannot price reality that has been upgraded before it reaches them. This is a Truth signal in institutional honesty.

But, after the fine was placed, the families distributions increased significantly. Roughly $10.7 billion left the company between 2008 and 2017, against about $1.3 billion in the twelve years before.

Years later, Purdue was in Chapter 11. The estate’s settlement climbed to $7.4 billion. Its assets and operations were transferred to a new public benefit corporation named Knoa Pharma, owned by the Knoa Foundation, which is dedicated to public health and opioid abatement.

The entire equity value of the firm was wiped out and the settlement took most of the owners distributions.

The questions that interested us from here were (1) why the market failed to price any post-conviction risk realization, and (2) whether this is some sort of bigger pattern.

So we did the following:

• We ran five historical cases backwards,

• stood at a documented decision point using only what was knowable that day,

• asked what a disciplined reading of the moral fragilities in the business would have flagged,

• then compared our findings to what had happened.

Five decision points

Purdue Pharma, May 11, 2007. The day after the plea.

On the record that day:

1. a federal conviction for misrepresenting addiction risk,

2. a 2003 GAO report documenting abuse, diversion, and aggressive marketing,

3. and a revenue base concentrated in the heaviest-using patients.

Outcome: bankruptcy in 2019, a DOJ resolution above $8.3 billion in 2020, dissolution. The White House CEA later estimated the opioid crisis cost $504 billion in 2015 alone - about fourteen times Purdue’s entire earnings.

Tobacco, May 24, 1994. The day after Mississippi filed the first state Medicaid-recovery suit. The industry had won essentially every individual smoker suit for the previous four decades, and it treated lawsuits as a cost it could manage. Four years later came the Master Settlement Agreement: 46 states, at least $206 billion over the first 25 years, with payments continuing in perpetuity. Cumulative payments reached $165 billion through 2024 and continue. The outcome is a permanent retroactive tax.

Wells Fargo, 2013. The year the Los Angeles Times documented it’s sales culture. The cross-selling that drove the bank’s valuation premium worked better when customers misunderstood, and the compensation system paid out. The penalties, when they came in 2016, were $185 million. Small for a bank that size. The real cost came in 2018: the Federal Reserve’s asset cap, freezing the bank at roughly $1.95 trillion, not lifted until June 2025, seven years later. Estimated cost: about $39 billion in foregone earnings. Roughly twelve dollars of blocked growth for every dollar of fine.

MindGeek, 2019. The year California prosecutors charged the GirlsDoPorn producers, whose content was monetized on Pornhub, while advocacy groups built the public case against the platform. The entire revenue model ran through two payment networks. On December 4, 2020, the New York Times published Kristof’s “The Children of Pornhub”. Mastercard and Visa suspended payments on December 10. Within days the major networks were gone. Pornhub purged roughly 10 million unverified videos, about 80 percent of its content, and the company was sold under distress in 2023. The direct penalties were trivial at $1.84 million. But the business model was destroyed in ten days.

Corporate Russia, March 2014. Crimea is annexed and the first sanctions hit. Every Western firm with major Russian exposure got hit with the same question: is this jurisdiction’s apparent stability real, or enforced? But there was already precedent for this here. The Yukos expropriation, beginning in 2003, had shown the courts working as a weapon of the state against a commercial target. Country-risk models price swings. They fail at pricing full on seizures. After February 2022: BP took a $25.5 billion pretax charge on its Rosneft stake. ExxonMobil impaired Sakhalin-1 and was then expropriated outright by decree, exiting empty-handed. Russia then enforced a mandatory sale discount of at least 50 percent, an exit tax later raised to 35 percent with the discount raised to 60 percent. Confirmed direct losses to foreign firms exceed $170 billion.

The clock

Line the five up and you get to see a clock in the making.

Two things stand out from the above cases.

First, every case gave years of documented warning. The shortest gap between a warning sign and a real consequence in this sample is about eighteen months. Nothing here was a surprise. The information was public, often federal, sometimes criminal.

Second, the clock has two speeds, like the second hand and the minute hand. The slow hand runs while damage is piling up on someone else’s budget: decades for tobacco, years for opioids. The fast hand starts when someone forces that cost back onto the balance sheet. Mississippi’s 1994 filing was such a tool: the MSA followed in four years, after thirty years of slow clock. The GirlsDoPorn prosecutions and the advocacy record were the tool forming around Pornhub; the trigger, when it came, took ten days. Courts and legislatures take five to thirty years. Two payment networks protecting their own franchises took ten days.

The Pornhub trigger is commonly misread. The Kristof column contained little that advocacy groups had not documented for two whole years. What the column added was a mainstream voice. Under sustained, documented pressure, you cannot predict when the detonator goes off but in this case you could have predicted it would.

The bill

The second pattern is what the final bill looks like. In every one of these five cases, fines and settlements were the smallest part of it.

The big money left. A regulator froze the bank's growth for seven years. Two payment networks pulled the rails out from under the platform. The courts turned tobacco's settlement into a permanent tax. The state took the oil assets outright. A risk model built on penalty benchmarks would have missed more than 90 percent of the Wells Fargo bill alone. And the losses? All significant, but different. Purdue died. Tobacco pays forever. Wells lost seven years of growth. MindGeek lost its model in ten days. Russia took up to everything on the books.

What five failures cannot tell

We picked these five cases because the bill was there to see. A sample chosen this way can tell you how big, what shape, how long the fuse. It cannot tell you how often this bill comes reckoning. For every Purdue there may be a dozen comparably exposed firms that carried the same fragility and walked away. Reading base rates out of a failure sample is the oldest error in risk writing. So there is more to do.

The honest claims from this work are conditional ones. What the record here does not show is the denominator: how many carried the exposure and never paid. This requires different work: assemble the full cohort of comparably exposed firms at the same starting date, including the ones nothing happened to, and follow everyone. We did that. The results, including the cohort where everyone paid and the nearly identical cohort where only two in ten did, are the subject of the companion essay.

On July 6, the SEC said a federal court had entered an order against Quest Education, its owner, and two former employees. The agency said the company presented itself as financial education while its largest revenue source was commissions from companies whose investments it promoted to customers. Quest received about $2.5 million in those payments.

The pattern:

The customers were people seeking control over their own retirement savings. The company offered guidance under an education label. Underneath that label was a sales channel funded by the investments being recommended. That structure turns instruction into a trust transfer: the customer carries the risk, and the educator collects from the other side.

Why it matters:

The moral wrong is selling direction while appearing to provide instruction. A person seeking financial education is not positioned like a customer entering a sales pitch. When the payment relationship is buried inside the advice, trust becomes the product being spent, which is a Truth signal in institutional honesty.

The federal government built a list to confirm citizenship before releasing mail ballots. In court, it conceded the list wrongly flags citizens as ineligible. A judge voided the plan on separate legal grounds. Rather than withdraw the list, the government asked to keep it in force while appealing. On July 7, the judge refused.

The concession comes from the government's own filing, recorded in the judge's written ruling. It is not an opponent's characterization. The ruling and the July 7 decision are both public record, corroborated by independent reporting.

The pattern:

Citizenship verification for voting has always run through the states, with the federal government entering only after the fact, to enforce. This order reversed that order of operations: a federal list, deciding in advance whether a citizen's ballot is mailed at all. Naturalized citizens and people with legal-name mismatches are the population this list has flagged in error before. Coverage thus far has tracked the scoreboard from which judge to which appeal — without asking why a tool already shown to misfire is still the one being defended.

Why it matters:

The wrong is not the verification of citizenship. It is knowing the verification tool brands citizens as ineligible, and choosing to litigate for the authority to keep using it rather than to fix it. An acknowledged defect treated as a legal obstacle, not a defect, is a different order of conduct than an honest error. This is an Authority signal: power pressed forward without legal grounding, on a record that already undercuts it. It carries a Truth dimension as well because a tool built to protect the vote is instead a documented source of wrongful disqualification.

Overview

Approximately 700,000 people — 500,000 residents plus an estimated 200,000 internally displaced persons who sought refuge there — are now trapped inside El Obeid, the capital of Sudan’s North Kordofan state. The Rapid Support Forces (RSF) have tightened an encirclement carrying the precise structural markers of the siege that destroyed El Fasher twelve months prior. On 20 June 2026, the UN Security Council issued a rare presidential statement warning of an “imminent risk of mass atrocities” and demanding the RSF halt its assault (UN News, 2026, June 20). Within 48 hours, the RSF launched a fresh drone wave.

This briefing applies the Moral Disorder Index (MDI) — a 195-country diagnostic framework measuring societal breakdown across seven dimensions — to analyse both Sudan’s position in the global disorder landscape and the specific mechanisms of “strategic silence” enabling the RSF’s advance. The argument is structural: El Obeid is not a surprise. It is the arithmetically predictable outcome of documented state complicity, accelerating humanitarian erosion, and a media environment incapable of sustaining attention.

Part I: The Siege — Eighteen Months in Five Phases

El Obeid has effectively been under RSF pressure since the war’s outbreak on 15 April 2023. Human Rights Watch confirmed in June 2026 that the city has experienced “18 months of siege-like conditions” (Human Rights Watch, 2026, June 26). Five distinct phases define the escalation:

The drone campaign is not incidental; it mirrors the documented RSF doctrine of infrastructure destruction as a ground-assault precursor. Drones caused over 80% of all civilian deaths in Sudan in the first four months of 2026 (UN News, 2026, May 11). In El Obeid, targets follow a deliberate logic: the main power transformer (blacked out 19 June), the dialysis centre, fuel stations, a market, a private girls’ school, and civilian vehicles on exit routes (OCHA, 2026, June 22). Reuters journalists entering the city in January 2026 found satellite imagery from Yale’s Humanitarian Research Lab showing approximately 100 new grave mounds appearing in two local cemeteries within a two-week window (Reuters, 2026, January 21).

Why El Obeid matters strategically: The city is the nodal point through which Sudan’s economic geography converges. It controls five arterial corridors linking Khartoum to Darfur, Kordofan, White Nile State, and South Sudan. Sudan’s sole functioning oil pipeline — which transports approximately 94% of South Sudan’s national budget revenue in crude — transits North Kordofan (African Security Analysis, 2026). El Obeid hosts the world’s largest gum Arabic exchange. And for the RSF — having lost its Khartoum-based parallel government in March 2025 — the city represents the eastern anchor of a contiguous territorial arc from the Libyan border to Sudan’s geographic centre, the “political project” analyst Ahmed Ben Omer described to Al Jazeera as the RSF’s post-Khartoum survival strategy (Al Jazeera, 2026, July 6).

Part II: The Atrocity Template — What El Fasher Predicts

The RSF’s post-victory conduct is not speculative. It is forensically documented. Amnesty International’s July 2026 report City Under Siege, Children Under Fire, based on 247 interviews — including 39 children — and 89 verified videos, concluded without qualification that the RSF committed crimes against humanity and ethnic cleansing during its El Fasher campaign (Amnesty International, 2026, June 30). The UN’s Independent International Fact-Finding Mission (FFM) found El Fasher massacres bore the “hallmarks of genocide” (Human Rights Watch, 2026, June 26).

ACLED documented over 1,300 civilians killed in the first week of RSF control in El Fasher — called “the most deadly week of the war” — noting this a conservative count given rapid mass grave proliferation (ACLED, 2025, December 11). The documented playbook includes: executions at berm escape routes (where RSF fighters told civilians they “would fill the berm with bodies”); killings inside a protected maternity hospital; mass sexual violence including against girls as young as 13; shipping-container detention centres where men died of heat and dehydration; and the systematic burning of Zaghawa villages after residents had already fled — evidencing ethnic intent to render areas permanently uninhabitable (Amnesty International, 2026, June 30). RSF fighters routinely used the Arabic term falangay — meaning slavery — during attacks on non-Arab communities. Nine of 19 verified execution videos show named RSF commander Abu Lulu personally executing civilians in plain clothing.

UN High Commissioner Volker Türk stated on 18 June 2026: “We have seen this playbook before. We know where it led then, and cannot allow a repeat of the preventable atrocities we documented in El Fasher and Zamzam IDP camp” (Human Rights Watch, 2026, June 26). El Obeid’s 200,000 newly-displaced residents — who fled there precisely to escape the RSF — are now at risk of meeting the same forces they fled, with no exit route available.

Part III: The Moral Disorder Index — Sudan’s Position and the Architecture of Silence

Sudan’s MDI Profile

The MDI assesses 195 countries across seven dimensions of moral and institutional disorder, scored 0–100 (higher = greater disorder). Sudan’s current profile (Run Date: July 1, 2026) places it at Rank 11 of 195 — within the top 6% most disordered nations on earth, in the Critical band, and on a worsening trend.

Two dimensions are analytically decisive for the El Obeid briefing. The Authority score (68.3) — the highest in Sudan’s profile and 20.9 points above the global mean — reflects “severe government corruption, lawlessness, or totalitarian control of institutions,” directly mapping to the RSF’s impunity and the SAF’s failure to protect civilians under its nominal control. The Coercion Score (78.2) is critical: the MDI flags that Sudan’s apparent order is not voluntary but state-enforced, meaning that even relatively lower-scoring dimensions represent compliance under threat, not functional governance. The RSF embodies this principle — the coercive imposition of order that has none of the properties of legitimate authority.

The Truth score (54.3), 13.9 points above the global mean, quantifies the information environment in which El Obeid is being allowed to deteriorate: systematic disinformation, suppression of free expression, and media manipulation are structural features of the Sudanese state, not exceptional wartime conditions. This score has a direct relationship to the “media failure” dimension of strategic silence — when the state itself suppresses truth, external media operates in a degraded information environment that enables neglect.

The Visualization: Sudan vs. UAE vs. Global Mean

The radar chart above plots Sudan’s seven MDI dimension scores against the global mean and the UAE — the RSF’s primary external weapons supplier, as documented by the UN Panel of Experts on Sudan (2024) and Reuters (2023). The contrast is structurally important: the UAE scores 31.3 (Rank 156 of 195, “Concerning” band) — far below Sudan’s disorder levels — yet materially enables the atrocity apparatus producing that disorder. UAE weapons and drone systems (likely Chinese-made FH-95s supplied through UAE channels) are documented as the primary driver of the 600% increase in drone-related deaths across 2024–2025 (Council on Foreign Relations, 2026). The UAE’s relatively low Authority score (24.0) reflects a functioning state apparatus — one with the institutional capacity to stop arms flows it is choosing not to stop.

This is the precise geometry of strategic silence: a Critical-band state (Sudan, Rank 11) being supplied by a Concerning-band state (UAE, Rank 156) with zero binding consequence.

The Three Dimensions of Strategic Silence

State Complicity. The conflict’s sustainability depends on external supply chains no non-state actor could self-maintain. The UAE provides consistent material support to the RSF, including weapons, drones, and logistical backing, “often under the guise of humanitarian or commercial partnerships” (Kenny, 2025, Critical Debates in Humanities and Social Sciences). Arms shipments are funneled through Chad and Libya to RSF-controlled areas, as documented by both Reuters (2023) and the UN Panel of Experts (2024). The RSF’s gold mines in Darfur — a primary war-financing mechanism — export through South Sudan to the UAE, where proceeds are converted to weapons and returned into the conflict economy (The Soufan Center, 2026, April 21). Egypt simultaneously provides the SAF with “staunch political backing, logistical support, and technical support,” including use of the East Oweinat airstrip for strikes on RSF positions. Both primary external sponsors sit within the diplomatic coalitions formally tasked with peace mediation.

Humanitarian Erosion. North Kordofan faces IPC Phase 5 (Famine) projections for Sheikan district in 2026, with ACAPS explicitly warning that “logistics strangulation” mirrors the famine conditions that developed in El Fasher and Kadugli (ACAPS, 2026, February 11). UNICEF reported 140 children admitted for severe acute malnutrition in Sheikan and Al Rahad in January 2026 alone. Affan et al. (2024) document that against a humanitarian need of 2.7billion,only2.7 billion, only 2.7billion,only323 million was contributed — a funding ratio of approximately 12% (Affan et al., 2024, BMJ Paediatrics Open). The Authority dimension (68.3) sits at the apex of disorder, translating directly into RSF impunity: no domestic accountability mechanism, no enforceable ceasefire, no judiciary, no independent press capable of generating sustained internal pressure. The Truth dimension (54.3) confirms that this is an information environment structurally hostile to documentation and accountability, making external media the sole oversight mechanism — and that mechanism is failing.

The MDI comparison with the UAE (Score 31.3, Rank 156, Concerning band) crystallises the moral geometry of the crisis. A state with functioning institutions and the lowest Authority score in this comparative set (24.0 — reflecting relatively clean governance) is materially arming a conflict engine scoring 68.3 on the identical dimension. This is not a failure of knowledge or capacity. It is a choice that the current accountability architecture has no mechanism to punish.

The Security Council’s 20 June 2026 statement — demanding the RSF halt its assault, warning of mass atrocity risk — contained no enforcement mechanism, no red line, and no consequence. The African Union failed at its first post-war summit to include Sudan as a standalone agenda item (Amnesty International, 2024, April 12). The ICC’s jurisdiction has not been extended beyond the original 2005 Darfur referral. Named perpetrators — including Abu Lulu, documented in nine verified execution videos — remain at liberty.

El Obeid represents a categorical test of whether international accountability retains deterrent function after El Fasher demonstrated it does not. On July 6, 2026, the Department of Homeland Security and Department of Justice published an interim final rule titled “Counter-UAS Authority for State, Local, Tribal, and Territorial Law Enforcement and Correctional Agencies,” effective July 1 with comments due September 4. The rule implements the SAFER SKIES Act by creating a framework for state, local, Tribal, and territorial law-enforcement and correctional agencies to conduct counter-unmanned-aircraft-system operations.

After completing a required training, qualifying agencies may detect, identify, monitor, and track unmanned aircraft without prior consent, warn operators, seize or confiscate aircraft, disrupt control, seize or exercise control, and use reasonable force if necessary to disable, damage, or destroy an unmanned aircraft that poses a ‘credible threat’ to people, facilities, large public gatherings, critical infrastructure, or correctional facilities.

The rule exempts these actions from federal aircraft, computer-crime, and wiretapping laws that would otherwise apply, as well as from conflicting state and local law. In exchange, agencies must get certified, file an operations plan, coordinate with the FAA and FCC, and keep audit trails and after-action reports

The Federal Register rule and GovInfo PDF are the primary legal text for the July 6 action, and the U.S. Code page is the official codified statutory authority that the rule implements. Public Law 119-60 is the enacted statute that contains Title LXXXVI, the SAFER SKIES Act, and its amendments to 6 U.S.C. 124n. The limitation is that the rule documents legal authority and required safeguards, but there is no independent outcome data about how state or local agencies will use the authority once certified.

The pattern:

Federal counter-drone authority has been treated as an exception because effective mitigation can require conduct otherwise constrained by aircraft-safety, computer-access, radio-interference, and communications-interception laws. The SAFER SKIES Act and the July 6 rule move that exception from a primarily federal protective tool into a repeatable certification pathway for state, local, Tribal, and territorial agencies. Drone operators near protected venues communications and/or control-signal data can be incidentally collected and then governed by retention, purge, and dissemination rules after the fact. The moral gap is that a narrow emergency exemption is being normalized as local operational capacity, with accountability shifted from ordinary legal prohibitions to compliance files, audit trails, and after-action reports.

Why it matters:

The wrong is that a state, local, Tribal, or territorial officer can now decide, on their own certification and without a warrant or court order, to disable, seize, or destroy someone's property and intercept the communications and control signals around it — conduct that would otherwise be a federal crime under wiretap, computer-access, and aircraft-protection law — based solely on that officer's own judgment that a drone poses a credible threat.

This maps to Authority — lawlessness / absence of rule of law as the primary signal, since the MDI methodology defines Disorder of Authority as corruption of legitimate authority, tyranny, and absence of rule of law, and the signal here is coercive force being authorized by self-certification rather than independent, prior review, with a secondary Truth — institutional confidence signal, since the public has no independent means of verifying an agency's own account of why force was necessary in a given case.
